Email list regulations in the United States are dictated by the 2003 act titled “Controlling the Assault of Non-Solicited Pornography And Marketing” (CAN-SPAM). This act doesn’t make it illegal to purchase email lists, but it does set a few parameters that you need to comply with: 1) Don’t use false or misleading header information or deceptive subject lines. 2) Allow recipients to opt out from communications and honor those requests promptly. 3) Identify the message as an advertisement. 4) Include the brand’s physical postal address within the email itself. Phone list regulations are dictated by the Telephone Consumer Protection Act (TCPA) and Telemarketing Sales Rule (TSR) which restrict telemarketing calls, automatic phone dialing, and prerecorded messages. TCPA also requires telemarketers to obtain consumers’ signed written consent before robocalling or robotexting them. Please make sure you comply with the above regulations.
